Transfer of Road i. Intent. This Agreement specifically addresses the ownership of, responsibilities for, and immediate and future transfer of the roads identified herein. This Agreement may be the basis for future transfers of roadway ownership and maintenance responsibilities of roads not anticipated by this Agreement if there is written agreement of the parties. Transfer of ownership or maintenance of the roads would result in a change to the roadway miles maintained by each respective jurisdiction. Ownership and maintenance responsibility for roads will include but not be limited to roadbeds, sidewalks, bike paths, right-of-way, and all curbs, culverts, drains, sluices, ditches, water storage areas, waterways, embankments, slopes, retaining walls, bridges, tunnels, viaducts and other roadway appurtenances existing at the time of the transfer, to be constructed in the future, or that are necessary for the operation and maintenance of travel and all ferries used in connection therewith. Upon transfer, the Parties intend that the County will give up all ownership, as well as complete and total responsibility for all maintenance obligations to all local road segments within the City, except as may be specified in this Agreement.
